1. כללי

ברוכים הבאים ל-agents&me. תנאי שימוש אלה (להלן: "התנאים") מסדירים את השימוש שלכם באתר getagents.today (להלן: "האתר") ובכל השירותים שמסופקים דרכו, לרבות הסדנאות הציבוריות והפרטיות של תום אבן.

Welcome to agents&me. These terms of use (the "Terms") govern your use of the getagents.today website (the "Site") and all services provided through it, including Tom Even's public and private workshops.

2. Services Provided

2.1 חלות על סדנאות B2B

2.1 Applicability to B2B Workshops

סדנאות פרטיות לארגונים אינן "עסקת צרכן" כהגדרתה בחוק הגנת הצרכן, והן מוסדרות בהסכם מסחרי נפרד (SOW או הסכם שירותים) בין הארגון לבין agents&me. סעיפי הביטול וההחזר בסעיף 4 להלן אינם חלים על סדנאות B2B. בהיעדר הסכם נפרד, יחולו תנאי ברירת מחדל מסחריים סבירים, וסמכות השיפוט תישאר כאמור בסעיף 11.

Private workshops for organizations are not a "consumer transaction" as defined in the Israeli Consumer Protection Law, and are governed by a separate commercial agreement (SOW or services agreement) between the organization and agents&me. The cancellation and refund provisions in section 4 below do not apply to B2B workshops. In the absence of a separate agreement, reasonable commercial default terms will apply, and jurisdiction remains as stated in section 11.

3. רכישה ותשלום

3. Purchase and Payment

תשלום על סדנאות מתבצע באמצעות שירותי סליקה חיצוניים (Grow ו-Morning). אנחנו לא שומרים פרטי כרטיס אשראי באתר. כל המחירים באתר כוללים מע"מ לפי השיעור הקבוע בחוק בעת הרכישה, אלא אם צוין אחרת.

Payment for workshops is made through external payment processors (Grow and Morning). We do not store credit card details on the Site. All prices on the Site include VAT at the statutory rate at the time of purchase, unless stated otherwise.

4. ביטול עסקה והחזר כספי

4. Transaction Cancellation and Refunds

בהתאם לחוק הגנת הצרכן, התשמ"א-1981, ולתקנות הגנת הצרכן (ביטול עסקה), התשע"א-2010:

In accordance with the Israeli Consumer Protection Law (חוק הגנת הצרכן, התשמ"א-1981) and the Consumer Protection Regulations (Transaction Cancellation) (תקנות הגנת הצרכן (ביטול עסקה), התשע"א-2010):

4.1 זכות ביטול כללית

4.1 General Cancellation Right

אתם רשאים לבטל את ההרשמה לסדנה תוך 14 ימים מיום ההרשמה, ובלבד שהביטול מתבצע לפחות 2 ימי עסקים לפני מועד הסדנה. זכות זו עולה בקנה אחד עם תקנות הגנת הצרכן (ביטול עסקה), התשע"א-2010, לעסקאות מכר מרחוק בשירותים.

You may cancel your workshop registration within 14 days of registration, provided the cancellation is made at least 2 business days before the workshop date. This right is consistent with the Consumer Protection Regulations (Transaction Cancellation), 2010, for distance selling transactions in services.

4.2 הארכת תקופת הביטול לאוכלוסיות מיוחדות

4.2 Extended Cancellation Period for Special Populations

אנשים עם מוגבלות, אזרחים ותיקים (גיל 65 ומעלה), ועולים חדשים (עד 5 שנים מתאריך העלייה) זכאים להאריך את תקופת הביטול ל-4 חודשים, ובלבד שהתקיימה עסקה הכוללת שיחה או התכתבות מתועדת בין הרוכש לבין העסק בעת ההרשמה או לפניה.

Persons with disabilities, senior citizens (age 65 and over), and new immigrants (up to 5 years from the date of immigration) are entitled to an extended cancellation period of 4 months, provided the transaction included a documented conversation or correspondence between the purchaser and the business at or before registration.

4.3 דמי ביטול

4.3 Cancellation Fee

במקרה של ביטול שאינו עקב פגם או הפרת חוזה מצדנו, וכל עוד הביטול מתבצע במסגרת זכות הביטול הקבועה בסעיף 4.1 לעיל, נגבה דמי ביטול בשיעור 5% ממחיר העסקה או 100 ש"ח, הנמוך מבין השניים.

In the case of a cancellation that is not due to a defect or a breach of contract on our part, and as long as the cancellation is made within the cancellation right set out in section 4.1 above, we will charge a cancellation fee of 5% of the transaction price or 100 NIS, whichever is lower.

4.3א ביטול בתוך פחות מ-2 ימי עסקים לפני הסדנה ואי-הגעה

4.3a Cancellation Less Than 2 Business Days Before the Workshop, and No-Shows

סדנאות ציבוריות הן שירות הניתן במועד מוגדר ובמספר מקומות מוגבל. ביטול שמתקבל בתוך פחות מ-2 ימי עסקים שאינם ימי מנוחה לפני מועד הסדנה, וכן אי-הגעה לסדנה ללא הודעה מוקדמת ("No-Show"), אינם מזכים בהחזר כספי ואינם מזכים אוטומטית במעבר למועד אחר. זאת בהתאם לסייג שבתקנות הגנת הצרכן (ביטול עסקה), התשע"א-2010, הקובע שזכות הביטול בעסקת שירות אינה חלה כאשר מועד מתן השירות חל בתוך פחות מ-2 ימי עסקים שאינם ימי מנוחה ממועד הביטול.

Public workshops are a service provided at a defined time with a limited number of seats. A cancellation received less than 2 business days (excluding rest days) before the workshop date, as well as failure to attend without prior notice ("No-Show"), does not entitle you to a refund and does not automatically entitle you to a transfer to another date. This follows the exception in the Consumer Protection Regulations (Transaction Cancellation), 2010, under which the cancellation right in a service transaction does not apply when the service date falls less than 2 business days (excluding rest days) from the cancellation date.

שינוי מועד ברגע האחרון: אם משתתף מבקש לעבור לסדנה במועד אחר במסגרת חלון 2 ימי העסקים הזה (במקום ביטול מלא ואיבוד הכרטיס), ולשיקול דעתנו הבלעדי, ניתן יהיה לאפשר זאת בכפוף לתשלום נוסף בשיעור 50% ממחיר הכרטיס המקורי, וזאת לכיסוי עלות תפעולית ותפיסת המקום שהוקצה ולא ניתן עוד למלאו. הסכמה לבקשה כזו אינה אוטומטית ותותנה בזמינות מקומות במועד החלופי. שינוי מועד שמתבצע יותר מ-2 ימי עסקים לפני הסדנה אינו כרוך בתשלום נוסף ויינתן לפי זמינות.

Last-minute rescheduling: if a participant asks to move to a workshop on another date within that 2-business-day window (instead of a full cancellation and losing the ticket), then at our sole discretion this may be allowed, subject to an additional payment of 50% of the original ticket price, to cover the operational cost and the allocated seat that can no longer be filled. Approval of such a request is not automatic and is conditional on seat availability at the alternative date. Rescheduling made more than 2 business days before the workshop carries no additional payment and is granted subject to availability.

סייג חשוב: הוראות סעיף 4.3א אינן גורעות מזכויות מוגברות לפי סעיף 4.2 לעיל (אנשים עם מוגבלות, אזרחים ותיקים בני 65 ומעלה, ועולים חדשים עד 5 שנים), ובכל מקרה של התנגשות יחולו הוראות סעיף 4.2.

Important caveat: the provisions of section 4.3a do not derogate from the enhanced rights under section 4.2 above (persons with disabilities, senior citizens aged 65 and over, and new immigrants up to 5 years), and in any case of conflict the provisions of section 4.2 prevail.

4.4 ביטול עקב פגם או הפרה

4.4 Cancellation Due to Defect or Breach

במקרה של ביטול עקב פגם, אי-התאמה, או הפרת חוזה מצדנו, יבוצע החזר כספי מלא תוך 14 ימים, ללא דמי ביטול.

In the case of a cancellation due to a defect, non-conformity, or breach of contract on our part, a full refund will be issued within 14 days, with no cancellation fee.

4.5 ביטול מטעמנו

4.5 Cancellation on Our Part

אנחנו שומרים את הזכות לבטל או לדחות סדנה במקרים של מחלה, כוח עליון, מיעוט נרשמים, או נסיבות בלתי צפויות. במקרה כזה תקבלו, לבחירתכם, החזר כספי מלא תוך 14 ימים או העברה למועד חלופי ללא תוספת תשלום. אחריותנו במקרה כזה מוגבלת למחיר ששולם בפועל, כאמור בסעיף 5.

We reserve the right to cancel or postpone a workshop in cases of illness, force majeure, low enrollment, or unforeseen circumstances. In such a case you will receive, at your choice, a full refund within 14 days or a transfer to an alternative date at no extra charge. Our liability in such a case is limited to the price actually paid, as stated in section 5.

4.7 מוכנות טכנית כתנאי לתרגול בסדנה

4.7 Technical Readiness as a Condition for Hands-On Practice

הסדנאות שלנו משלבות שני מרכיבים: לימוד (הסברים, הדגמות, צפייה) ותרגול מעשי על המחשב של המשתתף. רשימת התוכנות הנדרשות לתרגול והוראות התקנה מפורטות מראש בעמוד הסדנה ובאימייל הקבלה, והתקנתן לפני הסדנה היא באחריות המשתתף.

Our workshops combine two components: learning (explanations, demonstrations, watching) and hands-on practice on the participant's own computer. The list of software required for the practice, along with installation instructions, is detailed in advance on the workshop page and in the confirmation email, and installing it before the workshop is the participant's responsibility.

משתתף שמגיע ללא ההכנה הטכנית הנדרשת יוכל להשתתף בסדנה ולקבל את החלק הלימודי שלה במלואו (הסברים, הדגמות, צפייה בתרגול של אחרים, קבלת חומרי הסדנה), אך לא יוכל לבצע את החלקים המעשיים על מחשבו במהלך הסדנה. במצב כזה, וכיוון שהשירות סופק במלואו והאחריות להגיע מוכן הוטלה במפורש על המשתתף מראש, לא יוכר החזר כספי, החלפת מועד ללא תשלום, או פיצוי אחר. הוראה זו אינה גורעת מאחריותנו לבטל או לדחות סדנה בנסיבות כאמור בסעיף 4.5.

A participant who arrives without the required technical preparation will be able to attend the workshop and receive its full learning component (explanations, demonstrations, watching others practice, receiving the workshop materials), but will not be able to perform the hands-on parts on their own computer during the workshop. In that situation, since the service was provided in full and the responsibility to arrive prepared was explicitly placed on the participant in advance, no refund, free rescheduling, or other compensation will be recognized. This provision does not derogate from our responsibility to cancel or postpone a workshop in the circumstances described in section 4.5.

We make reasonable efforts to ensure the information on the Site is current and accurate, but we are not responsible for errors, omissions, or temporary unavailability of the Site.

The workshops provide information, not professional, legal, or medical advice. The decision to apply the material learned is your responsibility.

אחריותנו הכוללת בכל מקרה לא תעלה על הסכום ששולם בפועל עבור השירות הספציפי. הגבלה זו לא חלה במקרים של נזק מכוון, רשלנות חמורה, או הטעיה צרכנית בהתאם לחוק.

Our total liability in any case will not exceed the amount actually paid for the specific service. This limitation does not apply in cases of intentional damage, gross negligence, or consumer deception under the law.

תהליך ההתקנה במחשב המשתתף: מדריכי ההתקנה והחומרים הטכניים שאנחנו מספקים נועדו לסייע ולכוון בלבד, ואינם מהווים שירות תמיכה טכנית, ייעוץ IT, או התחייבות לתאימות עם כל מערכת הפעלה, מכשיר, או תצורה. תהליך ההתקנה מתבצע באחריותכם הבלעדית, על המחשב והרשת שלכם, ואיננו אחראים לתקלות, נזקים, אבדן מידע, או חוסר תאימות שעלולים להיגרם במחשב המשתתף בעקבות ההתקנה או הניסיון להתקנה.

Installation process on the participant's computer: the installation guides and technical materials we provide are intended to assist and guide only, and do not constitute a technical support service, IT consulting, or a commitment to compatibility with every operating system, device, or configuration. The installation process is carried out at your sole responsibility, on your own computer and network, and we are not responsible for malfunctions, damage, data loss, or incompatibility that may occur on the participant's computer as a result of the installation or an attempted installation.

6. קניין רוחני

6. Intellectual Property

כל התכנים באתר, לרבות טקסטים, עיצוב, סרטונים, איורים, ולוגואים, הם בבעלותנו או של בעלי הזכויות שהעניקו לנו רישיון שימוש. השימוש האישי בתכני האתר מותר. אסור להעתיק, לשכפל, להפיץ, או לעשות שימוש מסחרי בתכנים ללא אישור מראש בכתב.

All content on the Site, including texts, design, videos, illustrations, and logos, is owned by us or by rights holders who have granted us a license. Personal use of the Site's content is permitted. Copying, reproducing, distributing, or making commercial use of the content without prior written approval is prohibited.

חומרי הסדנה (מצגות, מסמכים, הקלטות) המועברים למשתתפים מיועדים לשימוש אישי בלבד. אסור לשתף אותם עם אחרים או להעלותם לפלטפורמות ציבוריות.

Workshop materials (presentations, documents, recordings) provided to participants are for personal use only. Sharing them with others or uploading them to public platforms is prohibited.

הקלטה מצדנו: אנחנו עשויים להקליט סדנאות לצרכים פנימיים (תיעוד, שיפור, סיכום לבוגרים). נודיע על ההקלטה בתחילת הסדנה. משתתפים שאינם מעוניינים להופיע בהקלטה מוזמנים לכבות מצלמה ולכתוב הודעה פרטית לפני תחילת הסדנה. ההקלטות נשמרות אצלנו, אינן מועברות לצדדים שלישיים לצרכים שיווקיים ללא הסכמה מפורשת נפרדת, ונמחקות לפי מדיניות שמירת המידע.

Recording on our part: we may record workshops for internal purposes (documentation, improvement, alumni recap). We will announce the recording at the start of the workshop. Participants who do not wish to appear in the recording are welcome to turn off their camera and send a private message before the workshop begins. Recordings are stored by us, are not transferred to third parties for marketing purposes without separate explicit consent, and are deleted according to the data retention policy.

We may update these Terms from time to time. Material changes will be published on this page and the update date will be noted at the top of the document. Continued use of the Site after an update constitutes agreement to the new Terms.

11. Governing Law and Jurisdiction

על תנאים אלה ועל פעילות האתר חל הדין הישראלי. סמכות השיפוט הבלעדית בכל מחלוקת נתונה לבתי המשפט המוסמכים במחוז תל אביב-יפו, ישראל.

These Terms and the operation of the Site are governed by Israeli law. Exclusive jurisdiction over any dispute is granted to the competent courts of the Tel Aviv-Jaffa district, Israel.

אם תניה כלשהי בתנאים אלה תיקבע כבטלה או בלתי אכיפה על ידי בית משפט מוסמך, יתר התנאים יישארו בתוקפם המלא.

If any provision of these Terms is found void or unenforceable by a competent court, the remaining Terms will remain in full force and effect.
